What happens if the buyer has no agent?
A straight answer on how a transaction with an unrepresented buyer works, when any fee applies, and why dual agency is never created.
The short answer
The transaction can still proceed normally. Any fee tied to an unrepresented buyer applies only when the listing agreement specifies it in writing, never automatically, and it never creates dual agency.
Handled through the written terms
An unrepresented buyer is handled through the written terms of the transaction. The seller's agreement governs whether any transaction-management fee applies, and that fee is never automatic.
Representation is defined in writing
Dual agency is never created by an unrepresented buyer; representation is defined by written agreement. The documents, not the absence of an agent, determine how each party is represented in the transaction.
